Judge Rejects U-Haul's Pop-Up Case

WASHINGTON -- In a ruling that could embolden providers of pop-up Internet advertisements, a federal judge has rejected a legal challenge filed by truck and trailer rental company U-Haul.

U.S. District Judge Gerald Bruce Lee handed down the ruling on Friday, dismissing U-Haul's lawsuit that sought to ban Internet advertising company WhenU's software, which launches rival pop-up ads when customers access U-Haul's website.

Lee said the ads don't violate the law because WhenU's software didn't copy or use U-Haul's trademark or copyright material, and because computer users had chosen to download the pop-up software.
