Canada Declares P2P Downloading Legal

A good day for Canuck file-sharers? Maybe.

Downloading copyrighted music from peer-to-peer networks is legal in Canada, although uploading files is not, Canadian copyright regulators said in a ruling released Friday.

In the same decision, the Copyright Board of Canada imposed a government fee of as much as $25 on iPod-like MP3 players, putting the devices in the same category as audio tapes and blank CDs. The money collected from levies on "recording mediums" goes into a fund to pay musicians and songwriters for revenues lost from consumers' personal copying. Manufacturers are responsible for paying the fees and often pass the cost on to consumers.

The peer-to-peer component of the decision was prompted by questions from consumer and entertainment groups about ambiguous elements of Canadian law. Previously, most analysts had said uploading was illegal but that downloading for personal use might be allowed.

interesting, legalize downloading, which consists of a downloader and an UPLOADER(S), and illegalize uploading....interesting...kind of defeats the purpose

I find it logical that Uploading instigates Downloading, thus allowing P2P to survive. What is being done is that the problem is being grabbed by the balls.

twiztid, well i can't go and say for certain as to this law, but i do know of other laws where it is legal to do one thing but illegal to do another. down here in the states (rhode island at least) it is legal to make and sell "black boxes", but it is illegal to use them

essentially, the decision says that the person with the absolute knowledge of the copyright is the one committing the crime, in this case the uploader. the downloader has no idea if the uploader has the legal right to disseminate the data or not, so they are not in violation of the law.
if you buy stolen merchandise from a pawn shop, you are not charged with receiving stolen goods, since the assumption is that the pawn shop has legal title to the goods when you purchase them. same with say ebay. its the "seller" that is held responsible for the legality of the transaction, with a few noted exceptions, like drugs.

dead on redwench, downloading p2p is legal, sharing copywrited material is not.

does that tax/tariff/reinbursement fund go to american artists?
wasnt the original agreement between riaa and canada?
