Xbox Mod Chips or Soft Mods

Hello,
I have a couple questions about modded xboxes. Would someone inform me of the legality or direct me to a source where I can read about whether modding an xbox is legal? As well what properties/circumstances make it legal to sell a premodded xbox if at all? either in chip or soft mod form? Are there regions that allow it?

Simple enough to say: What country do you live in? For instance, XBox mod's are legal in Spain but (As far as I am aware), are illegal in Australia.

You can buy pre-modded XBox's online, some are even sold as HTPC's!!!
IF you get a chip, make sure you get one with a switch so you can turn it off, otherwise you'll get banned if you play on XBox Live , although I believe you can pay to have it reset, and you can back it up as far as I can remember (your ROM that is).

You need a switch that can toggle between the modchip's BIOS and the default BIOS on the Xbox.
