Socom II Online Mic. Problems

This is very strange...........Sorry for the long story....just don't want to cause any confusion.
My brother and I play Socom II online. We don't play in the same house, he lives about 30 mins. away from me. He started to play Socom II Online just a couple of days ago. We are have in mic. issue.
1. If we are the only one in the game lobby, we cannot talk to each other until someone joins the room.
2. While we are in the game on the same team, just as long as someone else is alive other then me and brother, we can talk to each other. Once its just my brother and I playing, we can not talk to each other.
3. Same goes for being dead, if 3 or more people are playing and my brother and I are the only ones dead waiting for the next round. We have to wait till someone on our team is dead to talk to each other.
This has happen every single game we've played together, no random, nothing.........again, we can talk if someone else is in the room with us, but once that person leaves, we can't talk.
Remember we are not playing in the same house together. Hes many miles away from me.
This has happen every single game we have play together.
I posted this at Socom II message forums......no luck, but i have a few people say it may be a port issue.
Me: Running a Microsoft MN-100 router with the VDMZ....all ports open just to my Playstation 2.
Brother: Linksys G Router, not sure what settings....
Just doesn't make sense why we can't talk to each other unless someone else joins.
Comon techheads....riddle me this one..........
