Browser refreshing=Felony?

It is for this poor kid.

Asking folks in an Internet chat room to help crash his high school’s computer was a joke to one student.

School officials and Canton City Prosecutor Frank Forchione didn’t think it was funny.

On Wednesday morning, Forchione filed a felony criminal charge of disrupting public services against Michael W. Stone, 18, of 13634 Mogadore Ave. NW. Uniontown police arrested the Lake High School senior at the school.

“Michael said it was a joke,” Forchione said. “We showed him how we deal with this kind of joke.”

The incident occurred Dec. 2. Using a school computer, Stone created a blog on a Web site that encouraged others to use a link to another site. Once at the second site, Stone told users to “hold down F5 to help crash my school server,” according to police reports.

Crime? yes Felony? no.

I thought it was funny though that the site got slashdotted and then it really went down.

Yeah, the slashdotting was quite humerous - but it wasn't the refreshing that caused him the problems - it was the intent of taking down the web server. and actually, portscans performed by the /. crowd showed that they just decided to shut port 80 down since POP3 still responds.

Personally I think the kid saying it was a joke was the easiest but stupidist way to comment on his actions. Yes, it was pretty funny, but the fact is he should've said something more on the lines of, "I didn't know what would happen." By saying it was "just a joke" admits that he's guilty of it right there. You never admit you're guilty, no matter what the crime, look at Lorreana Bobbit and OJ, we all knew they did it, but they pleaded "not guilty" I do think the kid should have done something different though, not just crash the system...hmmm...delete....nah

This is fairly amusing.

Sad to say that ignorance lies within the depths of society when in fact this type of action could never be classified as a felony.

In fact, public school system administrators, believe anything that circumvents their intelligence is an illegal act, and a worthwhile criminal act. Yet the fact lies that they, Public School administrators, lack the experience and knowledge to correctly setup a network, and a full functional security policy. If precautions were made, their precious network would not have been vulnerable.

obviously, we have a high school student around

it could indeed be classified as a felony. the lack of an antivirus suite does not make a virus attack legal, for example. just as a lack of a burglar alarm or a lock doesnt make going into someone's house and spraying obscenities on the wall legal. his stated intent was to crash the school network, and that should be how the act is treated. of course, its a laughable felony, as he actually didnt succeed.
